Welcome to Safes for a Cause. These Terms of Use (“Terms”) govern your access to and use of our website, services, content, and related applications (collectively, the “Site”). By using the Site, you agree to be bound by these Terms. If you do not agree, please do not use this Site.

Acceptance of Terms

You confirm that you are at least 18 years old (or the legal age in your jurisdiction) and have the legal right to enter into this agreement. Your use of the Site constitutes your acceptance of and agreement to these Terms, as well as our Privacy Policy.

Changes to Terms

We may modify or update these Terms at any time without prior notice by posting the revised version on the Site. Your continued use after changes means you accept the new Terms.

Permissible Use / Prohibited Conduct

You agree to use the Site lawfully. You must not use the Site to:

- Violate any applicable laws or regulations

- Upload or transmit content that is harmful, defamatory, offensive, abusive, pornographic, infringing on someone's rights, or otherwise objectionable.

- Impersonate Safes for a Cause or any person or entity, or post with false credentials.

- Interfere with the operation of the Site, or attempt unauthorized access to parts of the Site or servers.

- Use automated tools (bots, scrapers) to access or harvest data from the Site without permission.

Intellectual Property

All content on the Site—text, graphics, logos, images, video, audio, software (“Content”)—is owned by Safes for a Cause or its licensors. You may view, download, or print content for your personal, non-commercial use only, provided you retain all copyright and trademark notices. Any other use requires our prior written permission.

User Content

If you provide content to us (comments, feedback, photographs, testimonials, etc.), you grant Safes for a Cause a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute and display such content. You represent that you own or have rights to submit the content, and that such content does not violate any laws or third party rights. We reserve the right to remove or refuse content that violates these Terms.

Disclaimers & Limitation of Liability

The Site and Content are provided “as is,” without warranties of any kind, express or implied. We do not guarantee that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

To the maximum extent permitted by law, Safes for a Cause, its directors, officers, employees, agents, and affiliates will not be liable for any direct, indirect, incidental, special, exemplary or consequential damages arising out of or in connection with your use of the Site or inability to use the Site, even if we have been advised of the possibility of such damages.

Third-Party Links

The Site may contain links to third-party websites or resources. These are provided for your convenience. We are not responsible for their content, accuracy, or practices. Visiting those sites is at your own risk.

Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of [Your State, e.g. Utah], without regard to conflict of law principles. Any dispute arising under these Terms will be resolved in state or federal courts located in Washington County, Utah.

Termination

We reserve the right to suspend or terminate access to the Site or features thereof, with or without notice, if you violate these Terms. Upon termination, all licenses and rights granted to you will cease.

Miscellaneous

If any part of these Terms is found to be void or unenforceable, that part will be severed and the rest of the Terms will remain in force.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Site, replacing any earlier agreements.

Temporary Storage Locker Terms of Use

1. Acceptance of Terms

Welcome to Safes for a Cause, LLC ("Safes for a Cause," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, our temporary storage locker kiosks ("Lockers" or "Service"), and any related services we offer. By accessing our website, renting a Locker, or otherwise using our Service, you agree to be bound by these Terms. If you do not agree, do not access the website or use the Service.

These Terms work alongside our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you also agree to the Privacy Policy.

A separate User Agreement is presented and digitally signed at each Locker kiosk before a rental begins. The kiosk User Agreement governs the specific rental relationship and supplements these Terms; in the event of any conflict between these Terms and the kiosk User Agreement with respect to a specific rental, the kiosk User Agreement controls for that rental.

2. About SafeReach and Safes for a Cause

Safes for a Cause provides temporary self-service storage Lockers placed at participating host locations, including Federal Firearms Licensees ("FFLs"), healthcare facilities, veterans organizations, and other community sites. Lockers allow individuals to securely store firearms and personal valuables for a defined rental period. The Service is operated under the Safes for a Cause brand and is designed to support safe storage during periods when individuals may benefit from temporarily separating firearms from their home environment, such as during travel, household transitions, or times of personal difficulty.

Lockers are accessed by the renter using a personal identification number ("PIN") that the renter creates at the time of rental. The host location does not take possession or custody of the contents of the Locker. The renter retains exclusive access to the Locker for the duration of the rental period.

3. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you are of legal age and have the legal right and authority to enter into these Terms and to possess and store any items you place in a Locker.

4. Account Identifier and PIN

To rent a Locker, you must provide a valid mobile phone number, which serves as your account identifier, and create a four-digit PIN. You are responsible for maintaining the confidentiality of your PIN and for all activity that occurs through the use of your phone number and PIN combination. You agree to notify SafeReach immediately of any unauthorized use of your account.

PINs are stored using cryptographic hashing and are not visible to SafeReach personnel, host location staff, or any third party in readable form.

5. SMS Communications and Consent

By providing your mobile phone number at a Locker kiosk and completing the rental signup process, you expressly consent to receive recurring automated SMS text messages from Safes for a Cause related to your Locker rental. These messages may include, but are not limited to:

Rental confirmation and account setup notifications

Alerts when your Locker is accessed or opened

Reminders before, on, and after your rental expiration date

Notices regarding unclaimed contents and abandonment procedures

Account or service-related notices, including changes to these Terms

Message frequency varies based on your rental activity. Message and data rates may apply. Consent to receive SMS messages is not a condition of any purchase. You may opt out of SMS messages at any time by replying STOP to any message. You may receive help by replying HELP. Opting out of SMS does not terminate your rental obligations but may impair our ability to notify you about your Locker, including expiration warnings. You remain responsible for retrieving your items and closing out your Locker before your rental ends regardless of SMS delivery.

6. User Responsibilities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree to:

Provide accurate, current, and complete information during the rental process

Comply with all applicable federal, state, and local laws, including firearms laws

Only store items that you have the legal right to possess

Retrieve your items and close out your Locker before your rental period ends

Promptly update your contact information if it changes during your rental

Not share your PIN with any other person

7. Prohibited Items

You may not place any of the following in a Locker: explosives, ammunition stored in unsafe quantities or configurations, hazardous materials, illegal drugs or controlled substances for which you do not have a lawful prescription, biological materials, perishable goods, live animals, currency or negotiable instruments exceeding reasonable personal amounts, or any item that you do not have the legal right to possess. Safes for a Cause reserves the right to refuse service or to require removal of any item that violates these Terms or applicable law.

8. Federal Firearms Compliance

When a Locker is hosted at a Federal Firearms Licensee location, the legal structure of the Service is designed so that the renter retains exclusive access via PIN and the host FFL does not take possession of the firearm. As such, ordinary rental activity does not constitute a transfer requiring ATF Form 4473 paperwork.

In the limited circumstance where a firearm is placed into a Locker and subsequently abandoned or not retrieved within the timeframes established in these Terms and the kiosk User Agreement, federal firearms regulations require the host FFL to log the firearm into its records. To facilitate compliance in such cases, we collect a physical address from the renter at the time of rental. This information is collected solely for regulatory compliance purposes and is not used for marketing or any unrelated purpose.

9. Fees

The Service is currently provided at no cost to the renter. Safes for a Cause reserves the right to introduce fees in the future, in which case fees and payment terms will be clearly disclosed at the kiosk before any rental that requires payment. No fee will be charged for any rental that began under a free-rental period without your express agreement to new fees.

10. Rental Period and Closeout

Each rental has a defined start date and end date displayed at the kiosk and confirmed via SMS. You may retrieve items from your Locker at any time during the rental period. You are responsible for removing all items and completing the closeout process at the kiosk before your rental end date.

Closeout must occur during the host location's regular business hours. Plan your closeout accordingly to avoid late retrieval and possible abandonment proceedings.

11. Abandonment of Property

If you do not retrieve your items and complete the closeout process by your rental end date, your Locker contents will be considered overdue. Safes for a Cause will send a series of automated SMS reminders following your rental end date, including escalating notices at one day, one week, one month, two months, and three months after the rental end date.

If your Locker remains unclosed and contents unretrieved three months after the rental end date, the contents may be deemed abandoned under applicable Utah and federal law. At that point, the host location may, in accordance with applicable law and Safes for a Cause's abandonment procedures, access the Locker, inventory and secure its contents, take possession of any firearms in accordance with federal firearms regulations, and dispose of, sell, or otherwise process the property as permitted under state abandoned-property statutes.

Persons experiencing financial or personal hardship affecting their ability to close out a Locker are encouraged to contact Safes for a Cause. Community resources and reasonable accommodations may be available.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. SAFEREACH DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SAFEREACH DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

You acknowledge that Locker security depends in part on the physical security of the host location, on proper PIN handling by the renter, and on factors outside Safes for a Cause direct control. You are responsible for evaluating the suitability of the Service for your storage needs.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFES FOR A CAUSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, HOST LOCATIONS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

SAFES FOR A CAUSE TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO SAFES FOR A CAUSE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100) IF NO AMOUNT WAS PAID.

14. Indemnification

You agree to indemnify, defend, and hold harmless Safes for a Cause, its officers, directors, employees, agents, content providers, customers, suppliers, and participating host locations from and against any and all claims, costs, expenses, damages, injuries, liabilities, losses, and proceedings arising from or related to: (i) your use of the Service; (ii) any breach of these Terms by you; (iii) any items you placed in a Locker; or (iv) any negligent or wrongful conduct by you or any other person accessing the Locker using your account credentials.

15. Termination

Safes for a Cause may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or if continued access poses a risk to other users, host locations, or Safes for a Cause. You may stop using the Service at any time by retrieving your items and closing out your Locker. Termination does not relieve either party of obligations that arose before termination.

16. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the Effective Date at the top of this document. Material changes will be communicated by SMS or by a notice on the kiosk before your next rental. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Washington County, Utah, and you consent to the personal jurisdiction of those courts.
